Synoiren's Terms of Service

Important

  • Personal statement about A.I.

  • Contacting me for a commission or filling a request form assumes that you (the Client) have read and agreed to all terms.

  • These terms and conditions are subject to change without warning. It is the Client's responsibility to review these terms with each commission request.

Work Etiquette

  • Commissions will be worked on in the order they have been paid. Be patient while I work on commissions before yours. You can watch my queue here (Trello board).

  • I will be responsible for keeping you updated on the process, notifying when I begin work and showing the Work-in-Progress as I go. WIPs will include a watermark and will usually be smaller than the finished Artwork will be.

  • Please don't rush. Turnaround time will usually vary between 2 to 8 weeks depending on the scope of the Commission and other Commissions ahead in queue.

  • Keep in mind I'm only human and therefore affected by things beyond my control (i.e. sickness, technical problems, other obligations, etc.) Should any such situation arise that would delay commissions, Clients in queue will be notified as soon as possible.

  • Characters with only text descriptions or mixed references (Ex. photos of people, clothing/accessories, copyrighted material, etc.) from different sources will generally be turned away. You must provide me with previous depictions of your character and/or reference sheet if you have one.

  • Character Design is not a service I can provide at the moment. This section will be updated if and when I do. For the moment, pardon the inconvenience.

Revisions

  • I will not do major changes (such as complete pose/angle changes, entire wardrobe changes, etc.) after the draft has been approved by you.

  • You have one round of revisions during the commission process for free before the lineart has been approved by you.

  • A flat rate of $35 applies to additional revisions and post-linework approval. Changes such as major pose changes, design alterations and extra additions are not allowed.

Payment

  • Payment through Paypal (in USD) is required before commission may be worked on.

  • Assuming your commission is still in queue, work will begin upon full payment or the 1st payment of an agreed payment plan (for commissions exceeding $250 USD).

  • Non-payment within 3 days of receiving an invoice from the Artist results in commission cancellation.

  • Finished commissions are not refundable.

  • If I have already started working on your commission, a partial refund may be available depending on the stage of project completion. When cancelled, your commission will be closed and removed from the queue. Files will be deleted.

  • Partial refunds may be available if I fail to deliver a commission in a reasonable, timely manner. (Exceeding 6 months with no communication). Leniency is allowed as long as delays in the expected project timeline are clearly communicated with you.

  • The Clients retain the right to not purchase commissioned artwork at any time. Please note that any payment done before refusal/cancellation will not be refunded under these circumstances. This statement relieves The Artist of being indebted to The Client if this occurs.

Copyrights, Sharing & Privacy

  • The Artist retains all copyright of the produced artwork. Transfer of the digital file of the work is not transfer of the copyright. The Client has permission to share the work publicly and use it on display for private use, but any reproduction of the work, especially reproductions that will be used for profit or commercial uses, is strictly prohibited unless approved by the artist in writing. Failing to do so is a crime and may result in legal action.

  • All characters depicted remain the intellectual property of their respective owners. I do not claim ownership over their designs.

  • Public sharing of artwork is part of my marketing as an Artist. This includes, but is not limited to, artwork potentially being displayed on my social media, personal website, and recording/streaming the Artwork process on Twitch, Picarto, and YouTube. It is assumed that you consent to the Artwork, as well as reference photos, being shown for these purposes, unless you have paid a privacy fee (+5%).

  • You may request for your commission to remain private during the ordering process. This means that I will not be able to stream work of, post WIPs of, or post completed versions of the Artwork until an agreed upon date in the future, if ever. This is what leads to the fee as it ultimately hurts my ability to advertise business representatively.

Use & Commercial Rights

  • You are allowed to repost the Artwork on social media with the condition that you provide me with proper credit for the work. When sharing commissioned Artwork publicly, credit must be given through clear and visible labeling, tagging, or verbal acknowledgement.

  • If sharing multiple times in a single platform, one initial credit is sufficient for remaining displays. (For example if you share the Artwork on Instagram, it is only necessary to tag the artist once in the first instance). Remaining tags are appreciated however!

  • You may request Commercial Use Rights for the commissioned Artwork during the ordering process at a fee. It is considered Commercial Use when a client is making any type of profit from the Artist’s work. The way fees are applied by commercial usage rights is broken into the following tiers:

  • +25% - YouTube, Twitch, Twitter, Social Media promotional material (Use in Digital monetized content. – Ex. Overlays, Emotes, Thumbnails, Banners)

  • +40% - Illustrations for self-published media (published by its author). – Ex. E-books, graphic novels, and/or physical copies of the media.

  • +100% - Reproduction, Selling, Merch (Use in merchandise for sale. – Ex. Art Prints, apparel designs, charms or keychain designs, etc.) **This fee is subject to increase at the scope of the project, such as applying to groups, businesses, and corporations.**

  • Purchase of these rights are a once done payment. I do not and will never ask for any form of royalties after the fact.

Artwork Delivery & File Sharing

  • Files will be uploaded to a Google Drive folder, then a link will be sent to you for access to this folder. That Drive folder will be available for 2 weeks after the commission is completed, unless otherwise requested, so it is vital that the Client downloads the files as soon as possible.

  • If the Client requires the files be sent again after the 2 week period, the Artist may require a $5 fee. Rendering, downloading and uploading may be required again which takes significant time and storage fees may apply for the Google Drive storage. This fee can be avoided if the Client downloads their files promptly or requests the Artist to hold on removing the folder for up to an additional 2 weeks.

  • Note that there will not be a physical product.

Client's Responsibilities

  • The Client is responsible to…

  • Not mint/sell the Artwork using the blockchain.

  • Not use the Artwork for generative AI purposes.

  • Not alter the Artwork in ways that obstruct or crop out signatures and watermarks without the Artist’s written permission to exclude edits for personal use (Ex. profile picture, social media banner).

  • Not remove or cover any of the Artist’s watermarks and signatures from the Artwork.

  • Not redistribute the Artwork without credit or for profit without proper rights to do so.

  • Not take credit for the creation of the Artwork.

Artist's statement against Gen. A.I.

I, Synoiren (A.K.A. Fabie), do not consent to any of my artworks to be used to train any A.I. model with intent to replicate human artwork, for profit or not.Please consider the effects of Gen. AI on human artists and real content creators, the decline in the quality of the media you consume, and the negative impact A.I. servers and datacenters have on the environment and global economy.Creativity should not be relegated to machines.Let's preserve human creative expression.💙
